The EU AI Act uses a risk based approach covering prohibited practices, high-risk systems, transparency obligations and minimal or no risk systems.

How does the AI Act risk assessment work?

The classification of an AI system depends heavily on its intended purpose and specific use case, rather than simply whether the technology itself is considered “AI”. High risk classification can arise, for example, from certain applications covered by Annex III or from AI systems that are safety components of products covered by relevant EU product legislation.

The checker uses your answers to identify which risk category may be relevant and which areas of the AI Act deserve further review.

What risk levels can the checker identify?

The assessment covers four broad categories: Unacceptable Risk – prohibited AI practices, High Risk – AI systems subject to extensive requirements, Transparency Risk – systems subject to specific transparency obligations, Minimal or No Risk – systems generally subject to fewer AI Act requirements.

The European Commission’s transparency obligations under Article 50 began applying on 2 August 2026, making this area particularly relevant for systems involving AI interaction, AI generated content, deepfakes, emotion recognition or biometric categorisation.

Are the AI Act requirements already in force?

The AI Act applies in stages rather than all at once. Some provisions have already applied, while other requirements have later application dates. For example, the Commission states that Article 50 transparency obligations apply from 2 August 2026, while certain high-risk obligations have later application dates.
